Third-Party Content

Clients are responsible for ensuring they have proper licenses and rights to any content (images, copy, assets) provided to us for use in projects.

Payment Terms

  • Invoicing: Invoices are issued according to project milestones or agreed schedules
  • Payment: Due within 14 days of invoice date unless otherwise specified
  • Late Payments: May result in project suspension and late fees
  • Refunds: Determined on a case-by-case basis as outlined in project agreements
  • Deposits: Non-refundable project deposits may be required

Project Workflow

Revisions

Project agreements specify the number of included revision rounds. Additional revisions beyond this scope will be billed at our standard hourly rate.

Timeline

Project timelines depend on client responsiveness and timely provision of required materials. Delays caused by client inaction may result in timeline adjustments.

Approval

Client approval of deliverables must be provided in writing. Silence or lack of response within specified timeframes may be considered approval.

Warranties and Disclaimers

Our Guarantee

We guarantee professional quality work delivered with skill and care. However, results (such as increased traffic, conversions, or revenue) cannot be guaranteed, as they depend on numerous external factors.

Website Functionality

Our website is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access or error-free operation.

Third-Party Services

We are not responsible for third-party platforms, tools, or services used in conjunction with our work. Any issues with these services must be addressed with the respective providers.

Limitation of Liability

To the maximum extent permitted by law, Silent Ape Media shall not be liable for:

Termination

Either party may terminate a project agreement with written notice. Upon termination:

  • Client is responsible for payment of work completed to date
  • Deliverables in progress remain property of Silent Ape Media until paid in full
  • Deposits and retainers are non-refundable
  • Any outstanding balances become immediately due

Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the course of our working relationship. This obligation survives termination of services.

Indemnification

You agree to indemnify and hold harmless Silent Ape Media from claims arising from:

  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content or materials you provide to us
  • Your use of our Services

Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If unresolved, disputes will be handled through binding arbitration in accordance with applicable laws.

Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any legal action must be brought in the appropriate jurisdiction.
